1. Who we are

GEM IT Solutions Group is a group of two companies under common ownership. We supply time & attendance, payroll preparation, workforce management and custom software to businesses in the Caribbean.

GEM IT Solutions Group LLC	A limited liability company organised in the State of Wyoming, United States, registered at 30 N Gould St, Ste N, Sheridan, WY 82801. Owns the GEM Time software and trademark and supplies the product.
GEM IT Solutions Group B.V.	A private limited liability company incorporated in Curaçao, registered in Willemstad. Sells, implements, trains and supports across Curaçao, Aruba, Bonaire, Sint Maarten, Trinidad & Tobago and the wider Caribbean.

Which company is responsible for your data depends on who you deal with. If you are a client or an enquiry in the Caribbean, that is the B.V. If your licence or contract is with the United States entity, that is the LLC. Either way, one message reaches both.

2. Two different roles

It matters which of these applies to you, because your rights differ.

We are the controller	For this website, our contact forms, downloads, quotations, and our own sales and support correspondence. This policy governs that data.
We are the processor	For employee data inside a system we run for your employer — GEM Time, iSolvedTime, clocks and payroll files. Your employer decides what is stored and for how long. We only act on their instructions. If you are an employee asking about your own clock records, contact your employer's HR department first. See also our GEM Time app privacy policy.

3. What we collect on this website

When you contact us or request a quotation

• Name, company name, job title
• Email address and telephone number
• What you wrote in the message, including anything you tell us about your company

When you download a document or guide

• The same contact details above
• Which document you downloaded and when
• Any answer you gave to a qualifying question, for example how many people you employ

If you reached us through a form hosted by LinkedIn (a LinkedIn Lead Gen Form), LinkedIn pre-fills those fields from your own LinkedIn profile and passes them to us. LinkedIn's own handling of your data is governed by LinkedIn's privacy policy.

Automatically, when you visit any page

• IP address, approximate location, browser and device type
• Which pages you viewed, in what order, and how long you stayed
• Which website or advertisement sent you here

4. Why we use it

• To answer you. If you ask us a question or request a quotation, we use your details to reply and to follow up.
• To send what you asked for. If you downloaded a guide, we email it to you.
• To follow up commercially. If you have been in contact with us about our products, we may send you occasional relevant updates. Every such email has an unsubscribe link, and one click is enough.
• To measure what works. Aggregated website and advertising statistics tell us which pages and campaigns are useful.
• To meet our legal and accounting obligations.

Our legal basis is your consent where you gave it, our legitimate interest in running and marketing our business, and the performance of a contract where one exists.

5. Cookies and analytics

This site uses Google Analytics and Google Ads conversion tracking. These set cookies that tell us how the site is used and whether an advertisement led to an enquiry. They do not tell us who you are by name.

You can block or delete cookies in your browser settings, and you can opt out of Google Analytics entirely using Google's opt-out browser add-on. The site works normally without them.

6. Who we share it with

We do not sell personal data and we do not trade it. We share it only with the suppliers we need to run the business, and only as far as they need it:

• Google — website analytics and advertising measurement
• LinkedIn — advertising and lead forms, where you used one
• Netlify — hosting of this website
• Our email and office providers — to receive and store correspondence
• Our accountant and, where legally required, the authorities

We also share data between the two companies in the group where it is needed to deliver or support what you bought — for example, a support question about the software itself reaches the United States entity that builds it.

Some of these suppliers, and one of our own companies, are located outside Curaçao, including in the United States and the European Union. Where data leaves the island, we rely on the supplier's standard contractual protections and, within the group, on an internal agreement holding both companies to this policy.

7. How long we keep it

• Enquiries that did not lead to business: up to 24 months, then deleted.
• Client records: for the duration of the relationship and 7 years afterwards, which is what our accounting obligations require.
• Website statistics: retained in Google Analytics under its standard retention setting.
• Employee data inside a client's system: for as long as that client instructs us to keep it. When a client leaves, their database is returned or destroyed on their instruction.

8. Your rights

You can ask us to:

• tell you what we hold about you;
• correct it if it is wrong;
• delete it, where we are not legally required to keep it;
• stop using it for marketing — this one we action immediately, no reason needed.

Write to info@gem-itsolutions.com. We answer within 30 days. If the data sits inside a system we run for your employer, we will pass your request to them, because it is their decision to make.

This policy is written to meet the Curaçao Landsverordening bescherming persoonsgegevens. If you are in the European Union, the GDPR gives you the rights listed above and we honour them on the same terms.

9. Security

Data in transit to this website and to the systems we host is encrypted with TLS. Access to client systems is restricted to named staff, protected by individual accounts, and logged. Backups are encrypted. No system is perfect — if a breach ever affected your data, we would tell you and the relevant authority without delay.

10. Children

This website and our services are aimed at businesses. We do not knowingly collect data from anyone under 16.

11. Changes

If we change this policy we update the date at the top. Material changes affecting people we already hold data on will be communicated by email.
